Terms of Service

1. Subject of the agreement

These Terms of Service (the "Terms") govern the use of the TalentyGo platform (the "Service") provided by TalentyGo LLC, registered office 30 N Gould St Ste N, Sheridan, WY 82801, USA ("TalentyGo", "we"). By using the Service, you fully accept these Terms.

TalentyGo is a SaaS platform offering job listing aggregation, AI deliverable generation (Cover Letter, Mock Interview, Salary Brief, Career Path, Resume Optimization), and related career advisory services.

2. Account and requirements

To use the Service you must:

  • Be at least 16 years old (EU) / 13 years old (US with parental consent per COPPA — we do not offer services to under-13).
  • Provide a valid email address and accurate information at registration.
  • Keep your credentials confidential; you are responsible for all activity on your account.
  • Not use the Service for illegal purposes or in violation of third-party rights (e.g. uploading other people's resumes without consent).

3. Acceptable use

Prohibited:

  • Reverse engineering, mass scraping, or decompiling the Service.
  • Attempting to access other users' accounts or bypass security measures.
  • Using AI deliverables for fraudulent purposes (e.g. untruthful resumes presented to recruiters).
  • Reselling or redistributing AI deliverables as your own product.
  • Overloading the infrastructure with unauthorized automated requests.

4. Subscriptions, payments, and auto-renewal

Pro and Career subscriptions are billed in advance (monthly or annually based on the chosen plan) via Stripe. Prices shown are in USD.

Subscriptions auto-renew at the end of each period, charging the saved payment method. You can cancel renewal at any time from /billing → Manage subscription (Stripe Customer Portal). Cancellation takes effect at the end of the already-paid period; no partial refund is owed for the current period (except as provided in our refund policy — see /refund-policy).

One-shot products (Cover Letter, Mock Interview, etc.) are single, non-recurring purchases. See /refund-policy for the applicable refund policy.

5. Intellectual property and licenses

AI deliverables generated for you (Cover Letter, optimized resume, Mock Interview report, etc.) are licensed for personal and unlimited use for job search purposes. You retain ownership of the content of your original resume and data you provide us. TalentyGo retains ownership of platform code, prompt engineering, models, and algorithms.

6. US-specific terms (FTC Section 5 + ROSCA)

For US residents we apply the following terms in compliance with FTC Section 5 (unfair and deceptive practices) and the Restore Online Shoppers' Confidence Act (ROSCA) for auto-renewing subscriptions:

  • Pre-purchase disclosure: before checkout you clearly see price, billing cadence, auto-renewal conditions.
  • Explicit renewal consent: subscription activation is recorded as explicit opt-in (single-click confirmation).
  • Self-serve cancellation: you can cancel your subscription online from /billing → Manage subscription (Stripe Customer Portal) without contacting customer service.
  • Pre-billing notification: 7 days before each annual renewal, you will receive a reminder email with price and cancellation instructions.
  • 30-day satisfaction window on one-shot products and on the first subscription payment (see /refund-policy).

Disputes with US users are resolved through binding individual arbitration (American Arbitration Association, Consumer Arbitration Rules) except where applicable law provides otherwise. No class action waiver applies to California users, who have the right to individual opt-out within 30 days of accepting these Terms by writing to [email protected].

7. Limitation of liability

The Service is provided "as-is" and "as-available". TalentyGo DISCLAIMS ALL WARRANTIES, express or implied, and we do NOT guarantee:

  • Outcomes of job applications, interviews, hiring decisions, or salary adjustments.
  • Accuracy, completeness, timeliness, or availability of job listings aggregated from third-party sources (LinkedIn, Indeed, USAJobs, Adzuna, etc.).
  • Behavior, reliability, or practices of employers/recruiters you contact through the Service.
  • That AI-generated deliverables (Cover Letter, Mock Interview, Salary Brief, Career Path, Resume Optimization) will produce a specific result. You are responsible for final review and use of deliverables.

To the maximum extent permitted by applicable law, TalentyGo's TOTAL AGGREGATE LIABILITY to a user is limited to the amount paid by the user in the 12 months preceding the event giving rise to liability. This limitation does not apply to bodily injury, gross negligence, or willful misconduct.

7-bis. Non-discrimination and equal opportunity

TalentyGo is committed to equal opportunity and non-discrimination in all aspects of its Service. We comply with applicable federal, state, and local anti-discrimination laws including Title VII of the Civil Rights Act of 1964, the Americans with Disabilities Act (ADA), the Age Discrimination in Employment Act (ADEA), and state-level equivalents.

What this means in practice:

  • Our AI matching system does NOT use protected demographic data (race, color, religion, sex, national origin, age, disability, genetic information, sexual orientation, gender identity, pregnancy, veteran status) to filter, rank, or recommend job listings.
  • We do NOT facilitate "screening out" of candidates for employers. The platform is user-facing: it helps candidates discover opportunities, not employers screen out applicants.
  • We do NOT fall within the scope of NYC Local Law 144 (AEDT Law) for automated employment decision tools, as we do not provide screening services to employers. If our use case evolves toward employer-facing screening, we will conduct an annual bias audit and provide candidate notice as required by AEDT.
  • We do NOT discriminate in providing access to the Service based on any protected characteristic.

If you believe you have been treated unfairly by our system, or you have concerns about bias or discrimination, please contact [email protected]. You also have the right to file a complaint with the EEOC (eeoc.gov) or your state's labor commission.

8. Applicable law and jurisdiction

For US users: the law of the State of Wyoming applies. Competent jurisdiction: federal and state courts of Wyoming, except where otherwise required by consumer protection law.

9. Changes to the Terms

We reserve the right to update these Terms. Material changes will be communicated via email with at least 30 days' notice; you may cancel your subscription free of charge before the changes take effect.
